(NewsNation) — While love is in the air for Taylor Swift and Travis Kelce as they prepare to head down the aisle, so is a strong legal and financial team ensuring that the billionaire musician’s assets are protected before she says, “I do.”

Shortly after Swift and Kelce got engaged in August, people wanted to know not if they would sign a prenuptial agreement — that was always a given, legal experts say — but how the two, primarily Swift, would protect her music and business empire.

The “Enchanted” singer officially hit the billionaire club in 2024 and is now worth $2 billion, according to Forbes.

Swift’s net worth is unique compared to other pop stars because most of her income comes exclusively through her music.

“She’s a master fortune and she’s unique in the music business because she is such a high earner,” said Marilyn Chinitz, a partner at BlankRome and an expert in marital and family law.

The one thing that she’s going to want to protect is all of the rights that she has to the music catalog, Chinitz stated, adding that it includes her publishing and touring rights and her business ventures.

More than $800 million of her fortune is from music royalties and touring, Forbes reported.

Her widely successful “Eras Tour” broke records, grossing over $2 billion, making it the highest-grossing tour of all time.

‘The Jewel in the crown’

While Swift’s music catalog and businesses are important, other parts of Taylor Swift’s business is doubly important.

“Her intellectual property rights, song catalogs and publishing income is the jewel in the crown,” Chinitz said.

Matrimony attorney Ken Jewell told NewsNation that Swift should put an intellectual property clause in her prenup and that her income should be classified as separate property.

“Not that she wouldn’t share part of the income with him, but when you do a hybrid, for example, 30% of the income is marital, and 70% is separate,” Jewell said.

If the agreement is written this way, she would be contractually bound to share 30% of her income with the Kansas City Chiefs star if they were to divorce,” Jewell said. Any change to this arrangement would require Kelce’s agreement to sign.

“If the marriage is faltering, what’s the likelihood that that person is going to come in and say, ‘I’ll go from a 70/30 arrangement to it all being your separate property’?” Jewell said.

The Kansas City Chiefs tight end’s $90 million net worth is dwarfed by his music superstar fiancée; he still has assets that need protecting, according to Jewell.

“He needs it as much as she does because he has ($90 million),” Jewell said. “It’s a substantial amount of money, and he doesn’t want to be giving up his share of the assets to her while she’s not having to give up any of her assets to him.”

Jewell and Chinitz both agree that the three-time Super Bowl champion’s income and future earnings should be treated as separate property.

“He has earnings from the NFL, he has endorsements, he has podcasts and he’s going to have future earnings. Maybe not as substantial as hers, but he’s still going to be quite wealthy,” Chinitz said.

Earlier this year, after weighing his retirement from the NFL, Kelce re-signed with the Chiefs for three more years for $54.7 million. He will reportedly earn $12 million in the first year of his contract, according to the NFL Network.

In 2024, Kelce and his brother, retired Philadelphia Eagles center Jason Kelce, signed a three-year deal with Amazon to take their “New Heights” podcast under the company’s Wondery brand.

Reports estimate that the deal was worth more than $100 million.

A split in Swift and Kelce’s marital earnings is unlikely

Unlike other couples who may have prenuptial agreements protecting income before they get married but sharing earnings made during the marriage, and whose income is much smaller than that of the football star and the “Bad Blood” singers, that won’t be the case for Kelce and Swift, Chinitz said.

“Absolutely not!” she said. “It’s too complicated. It just creates a huge mess.”
